LEGAL NOTICE

In accordance with article 10 of Information Society Services and E-Commerce Law 34/2002 of July 11, 2002 (la “LSSI”), we inform you that the website www.fundacionreinasofia.es (the “Website”) is operated by Foundation Reina Sofía (the “Foundation”), with employer identification number G-85600021, registered at the state-governed Registry of Foundations under number 356SND and domiciled at Palacio de La Zarzuela, S/N, Madrid 28048. This document contains the legal notice and the terms of use of the Website (the “Legal Notice”) that the Foundation makes available to users.

By accessing and using the Website you (“You” or the “User”) accept all and undertake to comply in full with the terms and conditions of this Legal Notice, and the Website’s Privacy Policy and Cookies Policy. You must therefore read this Legal Notice carefully each time You intend to use the Website, since the Website and its terms of use may change.

TERMS OF USE

You undertake not to use the Website for fraudulent purposes and not engage in any conduct that may adversely affect the image, interests and rights of the Foundation or of third parties. You also undertake not to damage, disable access to or overload the Website or in any way prevent its normal use and operation.

You are informed that the Foundation reserves the right to restrict, suspend or terminate your access to the Website, taking any technical measures necessary for this purpose should You breach the contents of the Legal Notice, Privacy Policy or any of the other terms and conditions set out in the Website. The Foundation reserves the right to exercise such measures if it has reasonable grounds to suspect that You are infringing any of the terms and conditions of this Legal Notice.

Finally, we inform You that the Foundation reserves the right, at all times, to decide on the continuity of the information services it provides via the Website.

Intellectual property

The intellectual property rights in the Website, including the layout of the contents of the Website, sui generis rights in underlying databases, the look and feel of the website, underlying computer programs (including source codes and object codes), and the various elements comprising the Website (texts, pictures, photographs, videos, sound recordings, etc.) (the “Contents”), are held by the Foundation or its licensees. The distinctive signs included in the Website (trademarks and trade names) are owned by the Foundation or its licensees.

Your use of the Website does not involve the assignment of any intellectual property rights in the Website, Contents and/or distinctive signs of the Foundation or of third parties. Except where it is legally permitted or the Foundation has given its prior authorization, You are expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, taking extracts from and/or reusing the Website, its Contents and/or distinctive signs of the Foundation.

Once You accept the terms and conditions, the Foundation authorizes You to use the Website, on a non-exclusive and worldwide basis, during the maximum validity period of the intellectual property rights as established in applicable legislation (except where your access to the Website is suspended with due cause) and so that You may use the Website in accordance with these Legal Terms.

You may not establish links to the Website without prior authorization from the Foundation. Should the Foundation authorize a link to its Website, the link must be established as follows:

- The link may only be to the Website’s home page. The link may only be to the Website’s home page.

- The link may not comprise frames that allow the Website to be viewed through internet addresses other than those of the Website or that in any way whatsoever show Website information alongside information contained on other websites.

- No false, inaccurate or incorrect statements about the Website and/or the Foundation may be made on the web page on which the link appears (the “Linking Site”).

- Under no circumstances does the authorization granted by the Foundation mean that the Foundation: (i) sponsors, collaborates in, verifies or supervises the content and/or services provided through the Linking Site; or (ii) is responsible for the content of the Linking Site. Under no circumstances does the authorization granted by the Foundation mean that the Foundation: (i) sponsors, collaborates in, verifies or supervises the content and/or services provided through the Linking Site; or (ii) is responsible for the content of the Linking Site.

- The Linking Site must faithfully comply with the law and may not, under any circumstances, feature any own or third-party content that: (i) is unlawful, harmful, immoral or indecent (i.e., content that is pornographic, violent, racist, etc.); (ii) leads or may lead the User to falsely believe that the Foundation subscribes to, endorses, adheres to, or in any way supports the ideas, statements or expressions, lawful or unlawful, of the Linking Site; (iii) is inappropriate or irrelevant to the Foundation’s activities.

Should any links fail to meet the above requirements, the Foundation will immediately delete the link, without further notice.

Linked Sites

In order to help You find additional information, we may include different types of links through which You can access other websites (the “Linked Sites”). In these cases, the Foundation acts as a supplier of intermediation services pursuant to article 17 of the LSSI.

Under no circumstances does the existence of such links indicate that the Foundation recommends, promotes, identifies with or agrees with the statements, contents or services provided through the Linked Sites. Consequently, the Foundation assumes no responsibility whatsoever for the content of the Linked Sites, nor for their terms and conditions or privacy policies. You bear exclusive responsibility for verifying and accepting such terms and conditions and policies each time You visit and use the Linked Sites.

If You believe that any Linked Sites contain any unlawful, harmful, degrading, violent or inappropriate content, You may notify the Foundation by emailing  secretaria@fundacionreinasofia.es. However, such notice will in no way oblige the Foundation to remove the corresponding link and/or content.

Communication of unlawful or inappropriate activities

If You or any other internet user become aware that any type of information or content featured on or facilitated by the Website is unlawful, infringes third-party rights, contravenes the terms of this Legal Notice or is in any other way harmful, immoral or indecent, You may notify the Foundation, indicating the following:

- the personal data of the reporting party: name, address, telephone number and e-mail address;

- description of the facts that reflect the unlawful or inappropriate nature of the content or information, as well as the specific address where such content or information is made available;

- where third-party rights such as intellectual or industrial property rights are infringed and the reporting party is not the holder of those rights, the personal data of the holder of the infringed right. It will also be necessary to evidence ownership of the infringed rights and, as the case may be, the authority to act on behalf of the holder where the holder is not the reporting party. ​​​​

In all cases, the Foundation reserves the right to suspend or remove any content that, while not unlawful, contravenes the terms and conditions of this Legal Notice, after assessing the rights recognized by law and in conflict in each case.

Foundation’s responsibility

You should be aware that communications through open networks are exposed to multiple threats and are therefore not secure. You are responsible for taking the appropriate technical measures to reasonably manage these threats, including having updated anti-virus and anti-malware software, as well as updated security patches for your browser. Should You require further information on security solutions to meet your particular needs, contact your internet service provider. To the fullest extent permitted by law, the Foundation assumes no liability for any damage or loss You may incur as a result of risks inherent in the medium used or for any damage or loss incurred due to vulnerabilities in your systems and tools. The Foundation does not guarantee that its systems are fully secure. Although it has taken the appropriate security measures, some vulnerabilities may still exist. Consequently, You should exercise caution when using the Website. The Foundation is only liable for the damage caused by use of the Website when such damage is directly due to gross negligence or malicious intent by the Foundation and provided You have not acted negligently.

The Foundation assumes no liability for:

- Damage or loss of any type caused to your computer hardware due to viruses, worms, trojans or any other harmful elements.

- Damage or loss of any type You may experience due to telecommunications network failures or disruptions whereby the Website service being provided is suspended, canceled or interrupted. You acknowledge that access to the Website requires services rendered by third parties that are beyond the control of the Foundation (e.g., telecommunications network operators, access providers, etc.), that the Foundation is not liable for the reliability, quality, continuity or operation of such services and that the Foundation is not responsible for guaranteeing availability of the service.

- Third-party information provided in cases where the Foundation provides an intermediation service as a supplier as defined in the LSSI, except where the Foundation was effectively aware of such information provided but failed to remove it.

Miscellaneous

In accordance with article 3 of the LSSI, the services and information the Foundation provides through its Website are subject to Spanish law.

If any of the provisions of this Legal Notice are declared null and void, that provision will be replaced or removed, although under no circumstances will this affect the validity of the remaining provisions of this Legal Notice.
